Rental Terms & Conditions

RoboRide LLC Vehicle Rental Agreement, Form RR-RA-01 (Rev. 10/2026). These terms apply to rentals made directly with RoboRide LLC. Your signed Rental Record shows your renter details, vehicle, rental period, rates and fees, and it is part of the agreement.

Notice: Renter’s insurance is primary

(Fla. Stat. s. 627.7263) The valid and collectible liability insurance and personal injury protection insurance of any authorized rental or leasing driver is primary for the limits of liability and personal injury protection coverage required by ss. 324.021(7) and 627.736, Florida Statutes.

1. Agreement; Definitions

This Vehicle Rental Agreement (“Agreement”) consists of the Rental Record completed for your rental, these Terms, checkout/return photos and any written addenda or extensions. “RoboRide,” “we” and “us” mean RoboRide LLC, a Florida limited liability company. “Renter” and “you” mean the person signing as Renter, who is jointly and severally responsible with every Authorized Driver. “Authorized Driver” means Renter and any additional driver listed in your Rental Record and approved by RoboRide in writing who meets Section 4. “Vehicle” means the Tesla identified in your Rental Record, including its tires, wheels, glass, keys, charging equipment, accessories and software features. “Rental Period” runs from when you take possession until RoboRide checks the Vehicle in. You acquire no ownership interest in the Vehicle.

2. Your Insurance Is Primary

The Insurance Notice above is part of this Section. You represent that you and each Authorized Driver carry a valid personal auto policy that meets Florida requirements (including personal injury protection (PIP) and property damage liability) and that extends to a rented or non-owned private passenger vehicle, and, unless RoboRide agrees otherwise in writing, collision and comprehensive coverage for physical damage to the Vehicle. To the fullest extent permitted by law, your insurance is primary for liability, PIP and physical damage to the Vehicle during the Rental Period. You will provide your insurance card or declarations page, authorize RoboRide to verify coverage with your insurer or agent, keep coverage in force throughout the Rental Period, and notify us immediately of any cancellation, lapse or change. If your insurer denies, limits or delays a claim (for example for commercial, rideshare or unauthorized use), you remain personally responsible for all resulting amounts. RoboRide does not sell insurance and no collision damage waiver is included unless stated in a signed addendum.

3. RoboRide’s Financial Responsibility

RoboRide maintains on each Vehicle the security required of a Florida vehicle owner, including PIP security (s. 627.733) and property damage liability (s. 324.022). Under s. 324.021(9)(b)2., Florida Statutes, a lessor under a rental of less than 1 year is deemed the owner for purposes of liability for operation of the vehicle only up to $100,000 per person and $300,000 per incident for bodily injury and $50,000 for property damage, plus, if the lessee or operator is uninsured or has limits less than $500,000 combined, up to an additional $500,000 in economic damages only, reduced by amounts recovered from the lessee, the operator and their insurance. Any insurance maintained by RoboRide is excess over your and every driver’s insurance to the extent permitted by law and does not cover your own losses or damage to the Vehicle on your behalf.

4. Eligible and Authorized Drivers

Only Authorized Drivers may operate the Vehicle. Each must (a) be at least 25 years old, or 21-24 only with RoboRide’s prior written approval and payment of the young-driver surcharge shown in your Rental Record; (b) hold a valid, unexpired, unrestricted driver’s license (no learner’s permits) and, for non-U.S. licenses, a passport and an International Driving Permit where required; (c) present proof of insurance meeting Section 2; and (d) provide license photos (front and back) and a selfie holding the license. You are responsible for anyone you allow to use the Vehicle. Operation by anyone other than an Authorized Driver is a material breach and may void any coverage.

5. Prohibited Uses

The Vehicle may not be used or operated: (a) by anyone not an Authorized Driver or whose license is suspended, revoked or expired; (b) for rideshare, delivery or transportation network services (e.g., Uber, Lyft, DoorDash, Instacart, Amazon Flex), peer-to-peer or other sub-rental, carrying passengers or property for hire, or any other commercial use, without RoboRide’s prior written consent; (c) to tow or push anything; (d) off paved roads, on beaches, sand, unmaintained roads, or through standing or flood water; (e) in races, speed tests, track events, drifting or stunts; (f) by anyone under the influence of alcohol, drugs or any impairing substance; (g) for any illegal purpose or to transport hazardous materials or contraband; (h) with smoking or vaping of any substance in or near the open Vehicle; (i) with animals, except service animals as defined by law, unless approved in writing; (j) outside the State of Florida without RoboRide’s prior written consent, and never outside the continental United States; (k) beyond its seating capacity; (l) recklessly or distracted; or (m) after tampering with, disabling or modifying the Vehicle, its software, cameras, GPS/telematics, odometer or driver-monitoring systems. Any prohibited use is a material breach; RoboRide may terminate the rental and recover the Vehicle, and you are responsible for all resulting loss.

6. Full Self-Driving (Supervised) and Driver-Assist Features

The Vehicle is equipped with Tesla Autopilot and Full Self-Driving (Supervised) (“FSD”). These are driver-assistance features; they do not make the Vehicle autonomous. The Authorized Driver is the operator at all times. Whenever FSD, Autopilot, Autopark or any Summon feature is engaged, the driver must remain in the driver’s seat (or, for Summon, within required range and line of sight), stay attentive with eyes on the road and hands ready to take control immediately, follow all Tesla on-screen warnings and owner’s manual instructions, and obey all traffic laws. You are fully responsible for the Vehicle, its operation, and all collisions, injuries, damage, citations and tolls while any such feature is engaged, exactly as if driving manually. You will not defeat or interfere with driver monitoring (e.g., steering-wheel weights or covering the cabin camera). Features may change through over-the-air updates; RoboRide makes no warranty about their performance or availability, and unavailability is not grounds for a refund. If your misuse causes Tesla to suspend FSD on the Vehicle, you will pay any resulting costs and loss of use.

7. Charging and Battery

Return the Vehicle with at least the battery state of charge shown in your Rental Record (or, if blank, the level at pickup). If returned lower, you will pay the recharge fee shown in your Rental Record. Tesla Supercharger sessions billed to the Vehicle’s account during the Rental Period are charged to you at Tesla’s actual cost plus an administrative fee of $1.00 per session, together with any Supercharger idle or congestion fees. Do not let the battery fully deplete; towing or mobile charging caused by a depleted battery is your cost. Move the Vehicle promptly when charging is complete and return all supplied cables and adapters (replacement cost will be charged).

8. Tolls

The Vehicle may carry a SunPass/E-PASS-compatible transponder or be billed by toll-by-plate. All tolls, toll-by-plate invoices and toll violation fees incurred during the Rental Period are billed to you at cost plus an administrative fee: for SunPass/E-PASS transponder tolls, $1.00 for each day with at least one toll, capped at $5.00 per rental week; for toll-by-plate invoices, $2.50 per invoice, capped at $15.00 per rental week. A rental week is each 7-day period starting at pickup. Tolls that post after return remain your responsibility and are billed the same way.

9. Traffic, Parking and Camera Violations

You are responsible for all traffic, parking, red-light and speed/school-zone camera citations, towing, impound and storage charges, and other fines incurred during the Rental Period. RoboRide may pay any such amount and bill you, plus an administrative fee of $25.00 per notice, and/or, as permitted by law, identify you to the issuing authority and transfer responsibility to you.

10. Damage, Loss and Your Responsibility

Except for normal wear and tear, you are responsible for all loss of, theft of and damage to the Vehicle from any cause during the Rental Period, whether or not you are at fault and including while parked or while FSD is engaged, including: (a) the cost of repair based on a written estimate or invoice from a repair facility selected by RoboRide (including Tesla Service or a Tesla-approved body shop), or, if the Vehicle is stolen or a total loss, its fair market value less salvage; (b) loss of use, measured by the daily rate in your Rental Record for each day the Vehicle is out of service, as documented; (c) diminished value; (d) towing, storage, impound, appraisal and reasonable administrative and claim-handling costs; and (e) damage to windshields and glass (including the glass roof), chips and cracks, tires and wheels (punctures, sidewall damage, curb rash), interior burns, stains and tears, undercarriage, and water/flood damage. Your insurer’s deductible and any amount it does not pay are your responsibility. If a damage deposit or deductible amount is shown in your Rental Record, RoboRide may charge it when damage is reported and apply it against the final amount owed; it is not a cap on your responsibility unless a signed addendum says so. You will cooperate with RoboRide and insurers in any claim.

11. Accidents, Theft and Incident Reporting

Notify RoboRide immediately by phone at (321) 395-1999 of any accident, theft, vandalism, damage, fire, flood, warning message or mechanical problem. For any crash involving injury, another vehicle or property, or theft, call law enforcement and obtain a police report within 24 hours, then send RoboRide the report number. Do not admit fault. Take photos and obtain the contact, license, plate and insurance details of all other parties and witnesses. Report theft to police and RoboRide within 24 hours and return all keys and key cards. Failure to report, or loss caused by leaving the Vehicle unlocked or a key card inside it, may void coverage and makes you responsible for the full loss.

12. GPS, Telematics, Cameras and Remote Access

You are notified and consent that the Vehicle is connected to the Tesla app and may be equipped with GPS/telematics, Sentry Mode and exterior cameras. RoboRide may collect and use location, speed, mileage, battery, charging, driving and feature-use data and camera footage to locate and recover the Vehicle, verify charges (tolls, charging, mileage), investigate incidents and claims, protect the Vehicle and enforce this Agreement. If the Vehicle is not returned when due without a written extension, is reported stolen, is used in breach of this Agreement, or payment fails, RoboRide may, where safe and as permitted by law, remotely lock the Vehicle, prevent it from being driven or restarted, enable speed limits, sound the horn or flash the lights, and recover the Vehicle; RoboRide will not intentionally immobilize a Vehicle while it is in motion. Recovery costs are your responsibility.

13. Keys, Key Cards and Phone Keys

RoboRide will issue the number of key cards shown in your Rental Record and may assign your phone as a Tesla virtual (phone) key, which RoboRide will revoke at the end of the Rental Period or upon termination. You may not add or remove keys or drivers, change key or PIN-to-Drive settings, share access, or remove RoboRide’s account access. Report a lost key card or phone immediately so access can be revoked. Lost or unreturned key cards are charged at the replacement-and-programming fee in your Rental Record. Sign out of personal accounts before return; RoboRide may erase personal data left in the Vehicle.

14. Return; Late and Early Return; Extensions

Return the Vehicle to the location, on the date and at the time shown in your Rental Record. The Rental Period ends only when RoboRide checks the Vehicle in. Extensions must be approved in writing (text or email is acceptable) before the due time. Late returns beyond any grace period shown in your Rental Record are charged at the applicable hourly or daily rate, plus any loss of use for a missed next rental. If the Vehicle is not returned when due and you do not respond to RoboRide’s demand, RoboRide may terminate this Agreement, recover the Vehicle and, as permitted by s. 812.155, Florida Statutes, report it stolen. Failure to return rental property or equipment upon expiration of the rental period and failure to pay all amounts due (including costs for damage to the property or equipment) are evidence of abandonment or refusal to redeliver the property, punishable in accordance with section 812.155, Florida Statutes. Early return does not entitle you to a refund of unused days at a weekly or monthly rate unless agreed in writing, and charges may be re-rated at the applicable daily rate. A Vehicle left after hours remains your responsibility until checked in.

15. Cleaning and Condition at Return

Return the Vehicle in the same condition as received, excluding normal wear and ordinary road dust. Excessive dirt, sand, mud, pet hair, spills, stains or odors will be charged the cleaning fee in your Rental Record. Evidence of smoking or vaping will be charged the smoking fee in your Rental Record plus odor remediation and loss of use. Unclaimed items left in the Vehicle may be discarded after 30 days.

16. Charges, Deposit and Payment

You will pay all charges in your Rental Record and all amounts arising after return, including mileage over the allowance shown in your Rental Record at the excess-mileage rate, charging, tolls, citations, damage, cleaning, late fees, administrative fees, applicable Florida sales tax and county surtax, and the Florida rental car surcharge where applicable (s. 212.0606, Florida Statutes). The odometer reading recorded by RoboRide controls. A refundable security deposit may be held by card authorization, Stripe or Zelle and will be refunded after return, less amounts owed. You authorize RoboRide to charge your card or Stripe payment method on file for all amounts due under this Agreement, including charges identified after return, with an itemized statement. You are responsible for reasonable collection costs, and the prevailing party in any action to enforce this Agreement is entitled to reasonable attorneys’ fees and costs.

Rentals longer than 8 days. For any Rental Period longer than eight (8) days, you authorize RoboRide to keep your payment card on file for the entire Rental Period and to charge it automatically once every seven (7) days for the charging, tolls and other incidental charges (including the administrative fees in Sections 7, 8 and 9) that posted during the prior week, plus applicable taxes. An itemized receipt will be emailed to you after each charge. Charges that post after the vehicle is returned, including late toll-by-plate invoices, will be charged to the same card when they post.

17. Mechanical Issues and Maintenance

Respond promptly to warnings; stop driving and contact RoboRide if the Vehicle may be unsafe. Do not authorize repairs or service without RoboRide’s approval. Approved expenses are reimbursed with receipts. If the Vehicle becomes unusable through no fault of yours, RoboRide’s sole obligation is to provide a substitute vehicle when reasonably available or refund prepaid charges for unused days.

18. Indemnification

To the fullest extent permitted by law, you will defend, indemnify and hold harmless RoboRide and its members, managers, employees, agents and insurers from all claims, losses, liabilities, damages, fines, penalties, costs and reasonable attorneys’ fees arising from the possession, use or operation of the Vehicle during the Rental Period by you or anyone you permit to use it, or from your breach of this Agreement, except to the extent caused by RoboRide’s own negligence or willful misconduct.

19. No Warranties; Limitation of Liability

Except as required by law, RoboRide makes no warranties, express or implied, including merchantability or fitness for a particular purpose. To the extent permitted by law, RoboRide is not liable for property left, carried or lost in the Vehicle, or for indirect, incidental, special or consequential damages (including lost profits or trip interruption) arising from mechanical failure, software or feature unavailability, connectivity or app outages, or charger availability, except to the extent caused by RoboRide’s negligence or willful misconduct.

20. Termination and Recovery

RoboRide may terminate this Agreement and recover the Vehicle without notice, wherever located and without breach of the peace, if you breach this Agreement, provide false or incomplete information, your insurance lapses, a payment fails, or the Vehicle appears abandoned, endangered or used illegally. You will pay all recovery, towing, storage and related costs.

21. Privacy of Your Information

RoboRide collects your name, contact details, date of birth, driver’s license and insurance information, photos of the front and back of your license, a selfie holding your license, payment details and Vehicle data to verify identity and eligibility, prevent fraud, process payments, administer tolls, citations and claims, and comply with law. We share it only as needed with payment processors (e.g., Stripe), Tesla, toll and government agencies, insurers and adjusters, law enforcement and collection agents. We do not sell your personal information. Images of IDs are stored securely and kept only as long as needed for the rental, claims, legal and tax purposes, then deleted. Requests to access or correct your information: roborideturo@gmail.com.

22. Electronic Signatures and Communications

You agree to sign and receive this Agreement, receipts, invoices and notices electronically. Electronic signatures, initials and checkbox acknowledgments have the same effect as handwritten ones under the federal E-SIGN Act and Florida’s Uniform Electronic Transaction Act (s. 668.50, Florida Statutes). You consent to transactional calls, texts and emails at the contact information in your Rental Record. Written approvals by text or email from RoboRide’s listed number or address satisfy any “in writing” requirement for extensions and consents. RoboRide may use automated and AI assistants to answer calls, texts, chats and emails and to help process bookings; a person at RoboRide reviews and approves every rental, and you may ask to speak with a person at any time.

23. Governing Law and Venue

This Agreement is governed by the laws of the State of Florida. Exclusive venue for any action arising from this Agreement is in the state courts located in Brevard County, Florida, and the parties submit to that jurisdiction.

24. General

Severability: if any provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions remain in full effect. Entire agreement: this Agreement is the entire agreement between the parties for this rental and supersedes prior discussions; changes must be in writing and accepted by both parties (electronic acceptance is sufficient). Failure to enforce a provision is not a waiver. You may not assign this Agreement or sublet the Vehicle. Your payment, indemnity, toll, citation, damage and privacy obligations survive termination and return.

Notice: Failure to return

(Fla. Stat. s. 812.155(6)) Failure to return rental property or equipment upon expiration of the rental period and failure to pay all amounts due (including costs for damage to the property or equipment) are evidence of abandonment or refusal to redeliver the property, punishable in accordance with section 812.155, Florida Statutes.
